In compliance with the provisions of Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE), users are informed that this section regulates the conditions applicable to payments made through the client area of app.moveyourwine.com, in relation to the services provided under the trade name Move Your Wine (MYW), belonging to MBE Airport Group.
1. Nature of the service and scope of shipments
The amounts paid through the payment gateway (virtual POS) correspond exclusively to the contracting, regularization or settlement of transport, logistics, customs management, disbursements and other associated professional services, previously requested, accepted or executed by the client.
The provision of said services is governed at all times by the General Transport Conditions of MBE Airport Group – Move Your Wine (MYW), which are available permanently on the website.
The amounts charged may correspond to services already rendered, services being rendered, or services to be rendered in the future, depending on the nature of the operation, the type of service and the terms agreed with the client.
2. Cancellation of services
The client may request the cancellation of a contracted service, provided that it has not yet been executed or that its execution has not yet begun. Once the service has been initiated — including the pickup, customs management or any other associated action — it will be understood to have been consumed in whole or in part, and the provisions regarding refunds in these conditions shall apply.
Cancellations must be communicated in writing by the client (email or through the client area), and will be effective from the moment they are confirmed by the MBE Airport Group – Move Your Wine (MYW) team.
3. Returns
The nature of the contracted services (transport, logistics, customs management, disbursements and/or associated professional services) makes them non-returnable once their execution has begun.
In cases where a shipment is returned to origin for reasons attributable to the client (e.g. incomplete or incorrect documentation, refusal by the recipient, failure to comply with destination regulations), the costs derived from said return, including new transport, storage, customs management or destruction fees, will be borne by the client.
4. Refunds
In the event of an overpayment, unjustified duplicate charge, or billing error, the client may request a refund through the client area or by contacting the Move Your Wine (MYW) team. Duly accredited refunds will be processed through the same payment method used by the client, within a maximum period of 14 business days from the verification, provided there is no legal impediment or cause preventing it.
Refunds shall not apply to correctly rendered services, costs derived from third parties, disbursements, or actions carried out to comply with legal, customs or regulatory obligations.
5. Express acceptance
Making any payment through the client area implies the express acceptance by the client of the General Transport Conditions of Move Your Wine (MYW) and of this Legal Information and Online Payment Conditions section. Said acceptance is formalized through an affirmative action prior to the payment confirmation, being an indispensable requirement for the correct processing of the operation.
